Quick Answer

Yes, bulk SMS is legal in India when it follows the TRAI TCCCPR 2018 rules. The business must register its entity, sender ID (header) and message templates on a DLT platform, send promotions only to people who have not blocked them or who gave consent, and send promotional SMS only between 9 am and 9 pm.

The law behind bulk SMS in India

Commercial SMS in India is governed by the Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR), issued by the Telecom Regulatory Authority of India (TRAI). These rules, with later amendments, are enforced by the mobile operators through blockchain-based DLT (Distributed Ledger Technology) platforms.

The idea is simple: every business that sends SMS must be known, every sender name must be registered, every message must match an approved template, and every customer's choice about promotional messages must be respected. Messages that break the rules are blocked automatically by operators before they reach the phone. Our TRAI regulations page lists the rules in detail.

What you must register on DLT

ItemWhy it is needed
Principal Entity (your business)Identifies who is sending; needs business documents such as PAN, GST or registration certificate.
Header (sender ID)The name customers see. Alphabetic headers are used for service and transactional SMS; numeric headers for promotional SMS.
Content templateThe exact text with variable parts marked. Messages that do not match are rejected.
Links and call-back numbersURLs and phone numbers inside messages must be whitelisted for your header.
Consent template (when needed)Records how a customer agreed to receive messages they would otherwise block.

Our team guides you through every step of DLT registration. The DLT portal itself may charge a one-time registration fee.

Promotional, service and transactional: what each may do

CategoryTypical contentDND numbersTime window
PromotionalOffers, discounts, new productsNot delivered to numbers that blocked promotions, unless consent is recorded9 am to 9 pm only
Service (implicit)Order, delivery, account and booking updates to existing customersDeliveredAny time
Service (explicit)Messages that need the customer's recorded consentDelivered with valid consentAny time
TransactionalOTPs and bank or payment alertsDeliveredAny time

Putting an offer inside a transactional or service template is not allowed; it turns the message into a promotion. See transactional SMS and promotional SMS.

Consent, NDNC and DND in practice

Indian mobile users can block promotional messages through the National Customer Preference Register (NCPR, earlier called NDNC). They do this by calling or texting 1909 or through their operator's app, and can block all promotions or only some categories such as banking or real estate. This is commonly called DND (Do Not Disturb).

Before a promotional SMS is delivered, the operator checks the number against these preferences. If the customer has blocked that category and there is no valid consent on record, the message is dropped. Customers can also report unwanted messages to 1909, and repeated complaints can lead to action against the sender, including suspension of headers and templates.

Checklist

A simple compliance checklist

  • Register your entity, headers and templates on DLT before sending.
  • Choose the right category for every template; keep offers out of OTP and service templates.
  • Send promotional SMS only between 9 am and 9 pm.
  • Collect and keep proof of consent where it is required.
  • Honour opt-out requests quickly and remove those numbers.
  • Whitelist every link and call-back number you use.
  • Use a DLT-approved provider that passes your entity and template IDs on every message.

Frequently Asked Questions

Yes. Bulk SMS is legal when the sender follows TRAI TCCCPR 2018: DLT registration of the business, sender ID and templates, respect for customer DND preferences and consent, and the 9 am to 9 pm window for promotional messages.

The Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR) issued by TRAI, along with its amendments and directions. Operators enforce it through DLT platforms.

Not unless the customer has given recorded consent to receive them. Without consent, promotional SMS to numbers that have blocked that category are dropped by the operator.

Promotional SMS can be delivered only between 9 am and 9 pm. Transactional and service messages, such as OTPs and order updates, can be sent at any time.

Operators block messages that do not match a registered entity, header and template, so they are not delivered. Repeated complaints or misuse can also lead to suspension of headers and templates.

Transactional messages such as OTPs and bank alerts, and implicit service messages to existing customers, do not need separate consent. Explicit service and promotional messages to customers who blocked them need recorded consent.
